Privacy Policy

This policy describes how Stealth Co LLC and our affiliates and subsidaries (collectively “Stealth Co”, “Company” or “we” or “us” or “our”) uses the Personal Information that we collect, receive, maintain, and share about you, or that is otherwise provided to, or collected by, us in connection with the products and services we offer (our “Services”). By using our website, applications, or electronic communications you consent to this policy.

1. Types of Personal Information Collected

We collect a range of Personal Information. “Personal Information” is information that identifies, relates to, describes, or is reasonably capable of being associated with or linked to an individual. When we combine Personal Information with other information (i.e., information that does not, on its own, identify you), we treat the combined information as Personal Information.

Contact Information

If you register for an account, submit an inquiry, sign up for our newsletter, or make a purchase we may collect information such as your name, email, password, mailing address, and phone number. We may also collect your age to verify your ability to purchase our products.

Payment Information

If you make a purchase, we collect your payment information such as credit card information, billing address and order details. We will also collect your purchase details or other purchasing or consuming histories or tendencies.

Account Information

If you create an account with us, you will create and provide us with a username and password and may upload other Personal Information through our customer portal. We may also collect your purchase information.

Location Information

While navigating our Platform your mobile device or browser may share your location data through Wi-Fi, GPS, RFID, and cellular technologies. We may collect this information based on the settings of your phone and browser.

Usage Information

When using our website or application we may collect usage and device information which may include information about your browser, operating system, ISP information, and your history on our platform.

Communication Information

We may collect audio, electronic, or visual information, which includes screen sharing views, product reviews, any data in any files uploaded, emailed, or otherwise provided by customers, the contents of your communications with us, whether via email, text messaging, social media, telephone or otherwise, and inferences we may make from other Personal Information we collect.

2. Method of Information Collection

We collect Personal Information in a variety of ways. We collect information directly from you; for example, when you register an account on the Platform, make a purchase, sign up for our newsletter, submit an inquiry, or otherwise correspond with us through the Platform.

We also collect Personal Information from third parties. For example, we work with business partners, subcontractors in technical and delivery services, advertising networks, analytics providers, and search information providers.

We also collect Personal Information from you when visiting and using our Platform. Our Platform uses tracking tools like cookies, pixels, and web beacons. We do this both on our Platform and in emails that we send to you. Through these tools we collect Personal Information about users over time when you use our Platform. This collection includes usage and browser information. We may also have third parties collect Personal Information in this way. For more information about the trackers that we use, please see the Cookies section of this policy. Additionally, if you enable location data on your device, this data will be collected passively based on the location settings on your device. 

3. Combining Information

We may combine Personal Information we obtain. For example, we may combine information that we have collected online with Personal Information that we have collected offline, for instance during calls between you and our support team. We may also combine Personal Information that we have collected across other third-party websites or from other third parties with Personal Information we already have. Finally, we may combine Personal Information across devices.

4. How We Use Personal Information

We will use your Personal Information to fulfill your purchases and offer our services, respond to your requests and inquiries, provide customer support, as well as to send you communications. We may also use your Personal Information to communicate with you for transactional purposes. For example, we might contact you about this Privacy Policy or our Terms of Use.

We may also use your Personal Information to improve our Platform, products, and services, conduct research, analysis, studies, or surveys, to identify usage trends, as well as for other analytic purposes. This may include using your Personal Information to customize your experience with us. We may also use your Personal Information for the security of the Platform and our company, our customers, and other third parties. We may also use your Personal Information to protect against fraud, claims and other liabilities, criminal activity, and other malicious activity.

We may also use your Personal Information for marketing purposes when you have given consent. For example, we may send you information about new features on the Platform, new services we offer, and special offers.

We may use your Personal Information to protect the security and integrity of our Platform, meet our contractual requirements, comply with applicable legal or regulatory requirements and our policies.

When we have a good faith belief that access, use, preservation or disclosure of the Personal Information is reasonably necessary to (a) satisfy or comply with any requirement of law, regulation, legal process, or enforceable governmental request, (b) enforce or investigate a potential violation of the Terms of Use, (c) detect, prevent, or otherwise respond to fraud, security or technical concerns, (d) support auditing and compliance functions, or (e) protect the rights, property, or safety of the Company, its users, or the public against harm.

When Selling or Merging the Company

If the Company is involved in a merger, acquisition, or any form of transfer or sale of some or all its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding. Personal Information may be transferred along with the business. Where legally required we will give you prior notice and if you have a legal right to do so, you will be given an opportunity to object to this transfer.

6. Cookies and Other Technologies

We collect some information about users over time on the website by using several common types of cookies and other tracking technologies such as web beacons and pixels. Web beacons, pixels, and other tracking technologies operate independent of cookies.

To assist us with analyzing our website traffic through cookies and similar technologies, we use analytics services such as Google Analytics. For more information on Google Analytics’ processing of your information, please see “How Google uses data when you use our partners’ Platforms or apps.”  You can opt out of Google Analytics by installing Google’s opt-out browser add-on. In addition, our website uses Google AdWords conversion tracking, Google Remarketing, and Google Signals. This site is protected by reCAPTCHA Enterprise and the Google Privacy Policy and Terms of Service apply.

Google Analytics uses cookies and similar technologies to analyse and improve our website based on your usage behavior. Google AdWords conversion tracking and Google remarketing also use cookies and similar technologies in order to measure the performance of advertisements placed and to show you individualized advertising messages on websites that collaborate with Google. Google Signals compiles for us multi-platform data reports on Google users that have enabled personalized advertising in their Google accounts. Users can opt-out of the Google Analytics Advertising Features through their Google Ads Settings, Ad Settings for mobile apps, Google Analytics Opt-Out Browser add-on, and the NAI’s consumer opt-out.

Functionality

Targeting or Advertising

From time-to-time, we may track and analyze usage and volume statistical information from individuals who visit the Platform. We may also enable advertising cookies to be placed on your computer so that we can understand what you are interested in and serve advertising on other websites based on your previous interaction with the Platform.

We also contract with third-party advertising networks and similar partners that collect IP addresses and other information on our Platform, from emails, and on third-party websites. Ad networks follow your online activities over time by collecting site navigational information through automated means, including using cookies. They use Personal Information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other websites.

You can control cookies and tracking tools. Some browsers have a “do not track” feature that prevents a website from tracking you, as well as additional cookie settings. Our Platform does not currently respond to these signals. If you choose to block cookies and other trackers, certain features of the Platform may not work. Blocking or rejecting cookies will not stop all the tracking described in this Policy. These features and options are browser and device specific and are not uniform. 7. Your Choices

Depending on where you live, you may have the right to exercise certain controls and choices regarding our collection, use, and sharing of your Personal Information. 

  • Right to Know – You may have the right to be notified of what categories of Personal Information will be collected at or before the point of collection and the purposes for which they will be used and shared.
  • Right of Access – You may have the right to be informed of and request access to the Personal Information we process about the applicant.  
  • Right to Rectification (Correct) – Under certain circumstances, you may have the right to request that we amend or update inaccurate or incomplete Personal Information about them.
  • Right to Erasure (Deletion) – Under certain circumstances, you may have the right to request deletion of their Personal Information.
  • Right to Data Portability – Under certain circumstances, you may have the right to request a copy of their Personal Information in an electronic format and further request that we send such Personal Information to another party.
  • Communication Preferences and Opt-Outs – You may have the right to stop receiving marketing communications from us at any time. To opt-out of marketing communications, please email us at support@stealthco.co or follow the instructions included in the email, or text correspondence. Please note that, even if you unsubscribe from certain correspondences, we may still need to contact you with important transactional or administrative information, as permitted by law. You may also have the right to opt-out of the selling or sharing of your Personal Information.

8. Children Under the Age of 18

Our platform is meant for adults and we will not knowingly collect personally identifiable information from any person under the age of 18 without permission from a parent or guardian. Our platform is not designed to attract the attention of persons under the age of 18.

9. California Privacy Rights

Subject to certain exceptions, this section applies to our collection and use of “Personal Information” if you are a resident of California. Pursuant to the California Consumer Privacy Act of 2018 and its implementing regulations as amended by the California Privacy Rights Act (the “CCPA”), this section describes (1) the categories of Personal Information, collected, and disclosed by Us, subject to CCPA, (2) your privacy rights under CCPA, and (3) how to exercise your rights.

When we use the term “Personal Information” in the context of the CCPA, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer or household.

We will retain each category of your Personal Information for as long as necessary to fulfill the purposes described in the “How We May Use your Personal Information” section above, unless otherwise required by applicable laws. Criteria we will use to determine how long we will retain your Personal Information include whether: we need your Personal Information to provide you with products or services you have requested; we continue to have a relationship with you; you have requested information, products, or services from us; we have a legal right or obligation to continue to retain your Personal Information; we have an obligation to a third party that involves your Personal Information; our retention or recordkeeping policies and obligations dictate that we retain your Personal Information; we have an interest in providing you with information about our services; and we have another business purpose for retaining your Personal Information.

Erasure You can request to have your Personal Information deleted from our servers and we will direct our service providers to do the same. However, please be aware that we may not fulfill your request for deletion if we (or our service providers) are required to retain your Personal Information for one or more of the following categories of purposes: (1) to complete a transaction for which the Personal Information was collected, provide a good or service requested by you, or complete a contract between us and you; (2) to ensure our website integrity, security, and functionality; (3) to comply with applicable law or a legal obligation, or exercise rights under the law (including free speech rights); (4) to otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided it.
Correction You have the right to request that we correct any incorrect Personal Information that we collect or retain about you, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see below), we will correct (and direct any of our service providers that hold your data on our behalf to correct) your Personal Information from our records, unless an exception applies. We may deny your correction request if (a) we believe the Personal Information we maintain about you is accurate; (b) correcting the Personal Information would be impossible or involve disproportionate effort; or (c) if the request conflicts with our legal obligations.
To Opt Out of the Sale or Sharing of Personal Information

We do not sell your Personal Information. However, you may have the right to opt out of us sharing your Personal Information. To exercise this right please email support@stealthco.co with the subject “Do Not Share My Info”.

Automated Decision Making You have the right to request information about the logic involved in automated decision-making and a description of the likely outcome of processes, and the right to opt out.

Pursuant to California’s Shine the Light statute (Cal. Civ. Code Sec. 1798.83), if you reside in California and have an existing business relationship with us, you may request information about our disclosure of certain categories of Personal Information to third parties for their marketing purposes, if any.

How To Exercise Your Rights

To make a request with respect to your privacy rights, please email us at support@stealthco.co.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your Personal Information. You may also make a request on behalf of your minor child.

You may only make a request for access or data portability twice within a 12-month period. The request must:

•    Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

•    Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

How We Respond To Your Rights

In all cases, we will respond to your request within 45 days. However, where reasonably necessary, we may extend our response time by an additional 45 days, provided we send you notice of such extension first. We will provide the information to you via your preferred delivery mechanism. If the information is provided to you electronically, we will provide you the information in a portable format and, to the extent technically feasible, in a machine readable, readily useable format that allows you to freely transmit this information without hindrance.

Please note that we will not charge you for making a request if you make no more than two (2) requests per year. If you make three (3) or more requests in any given twelve (12) month period, we may refuse to respond to such requests, if determined by us to be unfounded or excessive (e.g., repetitive in nature), or we may charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested. If we refuse to act on the request, we will provide you notice and the reason for our refusal to act. For example, if you request to delete Personal Information, we may retain Personal Information that we need to retain for legal purposes.

10. International Use Of The Platform

Our platform is meant for individuals residing in the United States and we will not knowingly collect personally identifiable information from any person outside of the United States. Our platform is not designed to offer any products or services to individuals outside the United States.

11. Exercising Your Individual Privacy Rights

You will not be discriminated against in any way by virtue of your exercise of the rights listed below, which means we will not deny goods or services to you, provide a different prices or rates for goods or services to you, or provide a different level or quality of goods or services to you.  

To exercise your privacy rights under applicable data protection law, please submit a request to us by e-mailing us at support@stealthco.co.  

Verification: We must verify your identity before fulfilling your requests.  If we cannot initially verify your identity, we may request additional information to complete the verification process. We will only use Personal Information provided in a request to verify the requestor’s identity. If you are an authorized agent making a request on behalf of a California consumer, we will also need to verify your identity, which may require proof of your written authorization or evidence of a power of attorney.   

We endeavor to respond to requests within the time required by applicable law. If we require more time, we will inform you of the reason and extension period in writing. 

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. 

We may deny certain requests, or only fulfill some in part, as permitted or required by law.  For example, if you request to delete Personal Information, we may retain Personal Information that we need to retain for legal purposes.

12. Storage, Security, and Retention of Information

We have taken reasonable steps to protect the information users share with us, including, but not limited to, setup of processes, equipment, and software to avoid unauthorized access or disclosure of this information. No transmission of information via the Internet can be entirely secure, however, so please always use caution when submitting personal information. We will retain your personal information in compliance with the uses described in this policy.

We store information inside the United States. By providing us with your personal information you agree to the processing of it in the United States as permitted by US law.

13. Links to Third Parties

We may include third party content and links to third party websites and services that collect personal information. We do not control these third parties and this policy does not apply to their privacy practices. We are not responsible for the practices of these third parties or how they use information you provide to them. Please read the third parties’ privacy policies carefully.

14. Updates

This policy may be amended from time to time. Unless otherwise indicated, any changes to this policy will apply immediately upon posting to the platform so please check our site periodically for updates. We will provide notice of material changes by updating the policy here and communicating with you in the manner and format in which we typically communicate with you in our regular course of business, as required by applicable law.
